Help Needed: Short-Term Rental Update
The survey results from our RLCAR membership were overwhelmingly in favor of our Association joining with the Village to file a complaint against the County Assessor's office for their continuing to classify short-term rented residential properties as non-residential. As such, we're engaging Zach Cook as our legal counsel who will represent us, the Village and a currently yet identified Lincoln County property owner in filing this declaratory action before Judge Suggs. HELP! We thought we had a taxpayer, a Lincoln County property owner whose property had been classified as non-residential (NR) or essentially commercial. However, Zack Cook realized that this particular property owner's deed was in the name of an LLC which would have provided the County with a counter argument which Zach doesn't want to have to address. So... PLEASE reach out to your current and past clients and help us locate one of your past or current clients who;
Use their residential property in Lincoln County as a short-term rental.
Have had the County reclassify their property from 'R' - residential to 'NR' - non-residential.
Have the property deeded in their individual name(s), not an LLC, partnership or corporate entity.
30 Days is all we have to identify this third plaintiff who will have standing in the eyes of the court. You can assure whomever you discuss this with that it will require minimum time on their part and all legal fees will be paid by the other parties (RLCAR and VOR). Also, before committing, Zack Cook will contact them and explain the entire case and process in detail.
